The Basics of Accident Claim Law
Because UK accident claim law is relatively complex it is advisable to consult an accident claim solicitor. All the same, even though the law is complicated, the injured part should be able to understand, if only at a basic level, how an accident claim works and whether they are entitled to claim in the first place.
Eleven million accidents annually cause person injury and solicitors estimate that two million of these are caused by someone else. Compensation is therefore a possibility for the accident victims for their personal injury and loss. The civil courts cover this type of claim, known also as personal injury.
Solicitors working on a no win no fee basis usually handle this type of claim. Only cases with a decent chance of success are therefore taken on. There are various factors which affect chance of success and right to make an accident claim.
The first issue is the timing. A limitation period of three years means that if the accident happened over three years ago it is incredibly likely to fail. It is important to remember that if the injury happens to a minor, the three year period only starts after their eighteenth birthday.
The injuries sustained in the accident and whether they were properly recorded by a doctor at the time will also affect the outcome of the claim. Notes taken by a doctor at the time of the injury will play a role in the claim. Seeking prompt medical advice is therefore incredibly important.
The success or otherwise of the case will also depend upon any witness accounts. Solicitors will liaise on the victim’s behalf with any police or emergency service staff who witnessed or attended the incident. Any other witnesses are also helpful. It is obviously better if witnesses give their version of events relatively soon after the incident before they forget any details. That said, the victim themselves should never collect statements. Collecting names and addresses of witnesses is advisable, though.
Lastly, the amount of evidence aside from the witness statements is important. Photographs of the scene of the accident from various angles and photos of injuries are helpful. A diary with lots of details should be kept during the recovery period. Any receipts for costs incurred by the injury should also be presented to the solicitor.
Accident claim law in the UK can be very complex, but it is important for accident victims to be aware of their rights and the process of making a claim. Speaking to an accident claim solicitor is still important.
